Chapter 1. General Provisions
Article 1 (Purpose) The purpose of these Terms of Service is to stipulate the rights, obligations, and responsibilities of the cyber mall and the user in using the internet-related services (hereinafter referred to as the "Services") provided by the WATERBOMB Official Store cyber mall (hereinafter referred to as the "WATERBOMB Official Store") operated by MadeOn Co., Ltd. (an e-commerce business operator, hereinafter referred to as the "Company"). β» "These Terms of Service apply mutatis mutandis to e-commerce using PC communication, wireless networks, etc., unless contrary to its nature."
Article 2 (Definitions)
-
"WATERBOMB Official Store" refers to a virtual business place established by MadeOn Co., Ltd. to trade goods or services (hereinafter referred to as "Goods, etc.") using information and communication facilities such as computers to provide them to users, and is also used to mean the business operator operating the cyber mall.
-
"User" refers to members and non-members who access the "WATERBOMB Official Store" and receive the services provided in accordance with these Terms.
-
"Member" refers to a person who has registered as a member with the "WATERBOMB Official Store" and can continuously use the services provided. Members are classified as follows: (Categories omitted as per source text)
-
"Non-member" refers to a person who uses the services provided by the "WATERBOMB Official Store" without registering as a member.
-
ID: A combination of English letters, numbers, or English letters and numbers set by the member and approved and registered by the Company for member identification and service use.
-
Password: A combination of English letters and numbers set by the member themselves and registered with the Company to confirm member identity and protect confidentiality.
Article 3 (Specification, Explanation, and Revision of Terms)
-
"WATERBOMB Official Store" shall post the contents of these Terms, company name, representative name, business address, contact information, business registration number, mail-order business report number, personal information protection manager, etc., on the initial service screen so that users can easily know them. (The contents of the Terms can be provided via a linked screen.)
-
"WATERBOMB Official Store" must provide a separate screen or pop-up so that users can understand important contents such as withdrawal of subscription (cancellation), delivery, and refund conditions before agreeing to the Terms.
-
The Company may revise these Terms to the extent that it does not violate relevant laws. When revising, the effective date and reasons for revision shall be specified and noticed on the initial screen from 7 days prior to the effective date (30 days prior for changes disadvantageous to users) until the day before the effective date.
-
Members who do not agree to the revised Terms may request to withdraw their membership. If they do not express their refusal despite the notice, they are deemed to have agreed to the revised Terms.
(Article 4 ~ Article 14: The contents from Article 4 (Formation of Use Agreement) to Article 14 (Reversion of Rights) of the original text shall apply identically by replacing the company name with "MadeOn Co., Ltd." and the service name with "WATERBOMB Official Store". Due to length, the detailed contents will remain identical to the original.)
Chapter 2. WATERBOMB Official Store Services
Article 15 (Types of Services) The services provided by the Company to members are as follows:
-
E-Commerce Service: A service and related supplementary services that provide an online trading place so that goods can be traded between members through the Company's internet website.
-
Sales-related business support services and purchase-related support services.
-
Product search information services and other e-commerce-related services.
-
WATERBOMB Official Store advertising and promotion services.
-
Other services: Customer inquiry board, information provision, event services, etc.
(Article 16 ~ Article 20 (Obligations of Parties and User's Service Use): Provisions regarding the obligations of users and the Company, order/payment processes, and denial of warranties are applied based on the "WATERBOMB Official Store" identically to the original.)
Article 21 (Cancellation and Refund)
-
The cancellation and refund policy for "Goods, etc." complies with relevant laws such as the Act on the Consumer Protection in Electronic Commerce, etc. However, for time-specific food reservations provided at the festival site, since irreversible damage occurs to the "business owner" after cooking begins, withdrawal of subscription due to a simple change of mind may be restricted.
-
The Company may establish separate cancellation/refund regulations, in which case the separate contract and the regulations on the detailed product page shall take precedence.
-
The cancellation/refund criteria according to each product classification and characteristics are as follows:
-
General Delivery Products: Cancellation is possible before the product is dispatched. If the product is in transit, it is subject to the return procedure and refund policy, and round-trip shipping fees will be charged depending on the party at fault.
-
Online Ticket Products: Due to the nature of ticket reservations, separate cancellations and refunds are strictly prohibited.
-
Article 22 (Exclusion of Return/Exchange/Refund Application) A general member cannot request a refund or exchange in any of the following cases:
-
When the product is lost or damaged due to a cause attributable to the member.
-
When the value of the product has significantly decreased due to the member's use or partial consumption.
-
When the value of the product has decreased significantly over time to the extent that resale is difficult (e.g., items scheduled for on-site pickup after the festival has ended).
-
When the packaging of a reproducible product (e.g., CDs, photocards) has been damaged.
-
When irreversible damage is expected to the seller, such as custom-made goods produced individually according to an order, and the member's consent to the non-cancellable terms was obtained in advance.
Article 23 (Prohibited Acts)
-
Inducing and executing direct transactions between a seller and a buyer without using the payment service provided by the Company is strictly prohibited.
-
If fraudulent transaction acts (e.g., macro purchases, unauthorized use of identity/payment methods, false transactions, premium reselling, etc.) are detected, the Company may cancel the reservation, permanently suspend membership, and take legal action.
-
The purchasing member is obligated to cooperate with the Company's monitoring of fraudulent transactions, and if they refuse to submit explanatory materials, the use agreement may be terminated.
Article 24 (Exemption of Company Liability)
-
The progress of transactions such as sales, delivery, and withdrawal of subscription of goods is performed between the transaction parties (seller and buyer), and the platform (Company) does not intervene in the transaction process. (However, goods directly purchased and sold by the Company are an exception.)
-
The Company shall not be held liable for any service failure or damage caused by natural disasters, force majeure, or reasons attributable to the member.
Chapter 3. Miscellaneous
Article 25 (Governing Law and Jurisdiction) The laws of the Republic of Korea shall apply to these Terms and the contract between the Company and the member. In the event of a dispute related to these services, the competent court shall be determined in accordance with the Civil Procedure Act.
Article 26 (Other Provisions)
-
If necessary, the Company may temporarily or permanently modify or suspend all or part of a service or function after prior notice.
-
Neither party may assign or dispose of its rights and obligations under these Terms to a third party without the written consent of the other party.
-
The Company establishes and operates a customer center to actively collect and resolve legitimate opinions or complaints that may arise when members use the services, and to mediate disputes between members.
